Three common misunderstandings

  1. I only intend to live with someone else and not to marry them. I need not bother you.

    WRONG! Cohabitation involves a measure of commitment and possibly there will be a sharing of finances. Your rights and obligations should be protected by a Living Together Agreement in order to avoid misunderstandings at a later date.

  2. I am marrying but have no money at the present time so I need not worry about a Pre-nuptial Agreement.

    WRONG! You will almost certainly acquire assets over the length of a marriage through savings, house purchase, pension provision and inheritances. Always take advice even if at the end of the day you decide not to have such an agreement.

  3. I am going to get divorced and will do it myself as the procedure is straightforward and I have downloaded all of the necessary forms - I don’t need your help.

    WRONG! Statistics show that most do it yourself divorces are never completed after the Divorce Absolute by obtaining Orders of the Court on agreed financial arrangements. You will require a solicitor’s input to ensure that all issues are properly addressed and, if need be, to arrange for a Financial Clean Break Order in order to prevent comebacks down the line.
