LICENSING LAWS

As many of you will have read in recent Press articles the new licensing regime came into effect on 21st November 2005. Even if existing licence holders did not wish to extend their opening hours or vary their Justices Licence in any way they still needed to apply under the transitional provisions of the Licensing Act 2003 to convert into the new system by no later than 6th August 2005. Anyone missing that deadline is unable to trade unless and until they make a successful application for a completely new licence.

Changes include tougher closure powers for the Police to enable them to deal with problem premises, increased penalties for offenders, the ending of fixed closing times, and the ability for local residents to ask for a review of an existing licence on the grounds of crime and disorder, public nuisance etc. A request for a review may now be made at any time and not just upon a renewal of the licence. Local residents can also oppose any new licence application and/or variation of an existing licence.
